Pike County District Attorney Raymond J. Tonkin announced the criminal sentences issued on June 10 by Pike County Court of Common Pleas President Judge Gregory Chelak:
Sean Michael Sullivan, 36, Netcong, N.J., was sentenced to 6 months of probation and fined $300 for the crime of Driving Under the Influence. Sullivan was stopped by the state police who observed him weaving across his lane of travel along SR 739 in Delaware Township and for an inoperable brake light on July 20, 2019. In speaking with Sullivan, the trooper detected the smell of an alcoholic beverage and observed Sullivan to have bloodshot, glassy eyes and slurred speech. Sullivan admitted to drinking prior to driving. Sullivan exhibited signs of impairment during the field sobriety tests, and a breath test confirmed a blood-alcohol content of 0.86 percent.
Jose Augustin Mompie, 62, of Gouldsboro, Pa., was sentenced to 6 months to 12 months in the Pike County Jail, fined $3,000, and had his driver’s license suspended for a duration to be determined by the Pennsylvania Department of Transportation (PennDOT) for the crimes of Driving Under the Influence and False Reports to Law Enforcement Authorities. The state police responded to a vehicle crash on SR 507 in Greene Township, where Mompie rolled his vehicle over and was observed by witnesses fleeing the scene. Partially consumed and empty beer cans were found in the vehicle. Mompie reported to the police the following day that his vehicle was stolen. Mompie was found to have been driving on a suspended license.
Luis Anthony Collazo, 47, of Bushkill, Pa., was sentenced to 72 hours to 6 months in the Pike County Jail, fined $1,000, and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence of a Controlled Substance. Collazo was pulled over by the state police for crossing the fog line with his vehicle along Milford Road in Lehman Township on March 3, 2020. Collazo was observed to have dilated pupils and acting in a nervous, anxious manner. Collazo admitted to smoking marijuana the previous night, and a blood test confirmed the presence of THC in his body.
Thomas V. Staria, 37, of Selden, N.Y., was sentenced to 10 days to 5 years in the Pike County Jail, fined $2,000, and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence. Staria was observed by the state police crossing the double yellow line of SR 402 in Palmyra Township on July 16, 2020. A traffic stop was initiated and contact made with Staria who was emanating the smell of an alcoholic beverage. Field sobriety tests indicated impairment, and a breath test confirmed a blood-alcohol content of 0.123 percent.
Jesse Steven Potenzone, 41, of Montague, N.J., was sentenced to 72 hours to 6 months in the Pike County Jail, followed by 6 months of probation, a fine of $1,300, and driver’s license suspension of 12 months for the crimes of Driving Under the Influence of a Controlled Substance and Possession of a Controlled or Counterfeit Substance. The state police were dispatched to SR 739 in Dingman Township where Potenzone was driving erratically. When Potenzone was located, he was unconscious behind the wheel of his vehicle, which was in drive and running. Potenzone was observed to have bloodshot eyes with constricted pupils. Potenzone admitted to consuming Oxycodone earlier in the day. Field sobriety tests indicated impairment, and a blood test confirmed the presence of Fentanyl and marijuana in his body.
Brian Clyde Berryhill, 25, of Dingmans Ferry, Pa., was sentenced to 6 months of probation and fined $300 for the crime of Possession of Drug Paraphernalia. During a Probation Office home visit, Berryhill was found in possession of a baggie used for the storage of marijuana at his residence in Westfall Township on Oct. 9, 2020.
Mark Richa Bohlinger, 28, of Lords Valley, Pa., was sentenced to 12 months of probation and fined $350 for the crime of Simple Assault. During a verbal dispute which became physical, Bohlinger choked an individual on Nov. 18, 2020, at a residence in Blooming Grove Township.
Tariq Spencer, 39, of East Stroudsburg, Pa., was sentenced to 12 months of probation and fined $1,000 for the crimes of Possession of a Controlled Substance and Possession of Drug Paraphernalia. On July 1, 2019, the state police responded to a business parking lot along SR 507 in Greene Township, where Spencer was in his vehicle behaving in a strange manner. When contact was made with Spencer, he admitted to consuming methamphetamine. A search of his vehicle revealed baggies containing methamphetamine.
Daniel Joseph Kulynych, 32, of Delaware Water Gap, Pa., was sentenced to 12 months to 7 years in a state correctional facility, fined $3,500, and had his driver’s license suspended for 18 months for the crime of Driving Under the Influence and the Summary Offense of Driving While Operating Privilege is Suspended or Revoked. The state police were advised by public safety that Kulynych was stopped along Mayflower Court in Lehman Township. When the state police made contact with Kulynych, the trooper detected the smell of an alcoholic beverage and observed him to have bloodshot eyes and slurred speech. Kulynych admitted to drinking prior to driving. Field sobriety tests indicated impairment. Kulynych refused to submit to a breath test. Kulynych was found to be driving on a suspended license that was the result of a prior DUI.
Devon Ariece Carson, 28, of Tobyhanna, Pa., was sentenced to a fine of $500 for the crimes of Possession of a Small Amount of Marijuana and Drivers Required to be Licensed. The state police pulled Carson over on July 2, 2019, when they observed him to be traveling strictly in the left lane along I-84 in Blooming Grove Township, although the right lane was clear. Upon speaking with Carson, the trooper detected the smell of marijuana and observed Carson to be acting nervous. Carson admitted to smoking marijuana. A probable cause search revealed Carson was in possession of marijuana. Carson was also found to be driving on an expired driver’s license.
Mark Christopher Hanway, 44, of Bushkill, Pa., was sentenced to a fine of $300 for the Summary Offense of Harassment. On Sept. 25, 2020, during a domestic dispute, Hanway struck or threatened physical violence in order to alarm an individual at a residence in Lehman Township.
